Por isso, as institui\u00e7\u00f5es financeiras oferecem linhas de cr\u00e9dito espec\u00edficas para tal finalidade, e, para tanto, emprestam dinheiro aos interessados que preencham os requisitos para o valor correspondente ao pre\u00e7o do im\u00f3vel que \u00e9 objeto de desejo.<\/p>\n<p>No entanto, com base da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9514.htm\" target=\"_blank\" rel=\"noopener\">Lei 9.514\/1997<\/a>, o im\u00f3vel adquirido pertence ao Banco, como garantidor de que o cliente pagar\u00e1 todas as parcelas acordadas, sendo certo que, ap\u00f3s sua quita\u00e7\u00e3o, o im\u00f3vel passar\u00e1 para o nome dos promitentes compradores. Neste per\u00edodo de amortiza\u00e7\u00e3o e pagamento do empr\u00e9stimo habitacional tomado, o cliente det\u00e9m a posse direta do im\u00f3vel, podendo nele residir.<\/p>\n<p>Trata-se de um contrato de aliena\u00e7\u00e3o fiduci\u00e1ria, semelhante aos j\u00e1 praticados para a aquisi\u00e7\u00e3o de ve\u00edculos e equipamentos.<\/p>\n<p>Referida legisla\u00e7\u00e3o prev\u00ea que, na hip\u00f3tese do cliente, promitente comprador, tornar-se inadimplente, o banco credor poder\u00e1 promover a retomada do im\u00f3vel sem qualquer interven\u00e7\u00e3o do poder judici\u00e1rio.
